Terms and Conditions for Users
The legal foundation governing the use of our services for club users.

1. Glossary
Netatoo: refers to the company Netatoo S.A.S. SIRET 48782045800031; also referred to as "we," "our," "us" in this document.
Application: refers to the online booking platform BalleJaune and OpenResa, accessible from the domain names ballejaune.com and openresa.com.
Club(s): refers to an entity represented by one or more administrators (association, municipality, company, etc.).
User(s): refers to individuals with an account in a club's database.
Administrator(s): refers to the person(s) responsible for the club, having full or partial access to the Administration section of the application.

2. Our Application
Netatoo SAS (SIRET 48782045800031) provides an online booking platform (ballejaune.com and openresa.com) allowing users to book time slots on the booking boards of registered clubs (association, municipality, company, etc.). All bookings made by users of a club represent a direct contractual relationship between the user and the corresponding club.
Netatoo acts as an intermediary between the club and the users. The information provided on the club's web space is managed exclusively by the club and, as such, the club is fully responsible for updating all rates, availability of time slots, and other information displayed on its pages.
While we exercise reasonable skill and care in performing our services, we do not verify and cannot guarantee that all information collected by Netatoo on behalf of the club is accurate, complete, or correct. Netatoo cannot be held responsible for errors (including manifest and typographical errors) of inaccurate or misleading information that may be collected and displayed on the club's pages.

3. Visibility of Booking Details
A club may configure its account so that the details of your booking are visible to others besides you and the club administrators. A club may also change settings in its account at any time, which may affect the visibility of your existing bookings.
By making a booking, you agree that the basic details of your booking may be displayed to others interacting with the club's account. These basic details are 1) your first name/last name or your identifier, 2) the booking times and the reserved location, and 4) the booking label (if applicable).
We are not responsible for the consequences related to the disclosure of booking details. If you have any doubts about how the details of your booking will be viewed by other users, you should first contact the club and seek clarification before making a booking.
Netatoo provides you with privacy settings in the "My Account > Privacy" menu. You can, in particular, hide your identity (name/first name) or your photo, or define a "whitelist/blacklist" mechanism to decide who can book with you and who can send you a message from the internal messaging system. It should be noted that these settings do not apply to club administrators who will always be able to view your information.

4. Payment for Bookings
The club may configure a ticket or point system on a user account. In this case, the user must have a certain number of tickets/points on their account to make a booking or an invitation.
- A "ticket" is a virtual unit defined by the club in its account configuration. For example, a ticket may equal a 60-minute booking. In this case, if the user has 5 tickets on their account, they can then schedule up to 5 slots of 60 minutes.
- A "point" is a virtual unit defined by the club in its account configuration. For example, a point may equal 1.00 EUR. In this case, if the user has 25 points on their account, they can book a Tennis slot for 10 points (i.e., 10.00 EUR) and a Padel slot for 15 points (i.e., 15.00 EUR).
If the club has configured an online payment provider on the application such as PayPal or Paybox, the user can purchase tickets or points at the rates established by the club. Otherwise, the user is invited to contact the club to obtain units.

5. Cancellation of Bookings
If a booking is blocked, it means it cannot be canceled by the holder. Each club may prohibit the cancellation of bookings by users or set a margin that dictates the time allowed for the user to cancel their booking. The margin is a time interval in minutes (e.g., 60 minutes). By using our application, you can cancel a booking you made if you proceed with the cancellation before the allowed time limit is reached (e.g., up to 60 minutes before the start of the slot).
The booking status, as well as the booking cancellation options, are always detailed during the final step of the online booking process and in the "My Account > Subscription" menu. By completing the booking, you accept the cancellation conditions set by the club.
When you make a booking, the club in which you book may cancel or reschedule your booking for you. You will be notified by email or SMS in this case, provided that your email address is entered on your account and notifications are enabled (menu "My Account > Notifications").
If a "ticket" or "point" system is configured on your user account, the tickets/points corresponding to the canceled booking will be automatically re-credited to your user account.

6. Email & SMS Notifications
Except for communications initiated by the application or the club regarding the specific cases listed in this section, we will not send you any unsolicited emails or SMS.
If your email address is entered on your account, you may receive email notifications during events on the application, for example, when a booking including your name is confirmed.
For security reasons, certain email notifications are enabled by default when your account is created. However, you can change your preferences at any time by going to the "My Account > Notifications" menu or by clicking on the link present in the emails received in your inbox. For example, you can choose not to receive email notifications when the club sends you a message from the application, but you will continue to receive messages from the club on the application's "internal" messaging system.
Trigger Events:
- when you log in to the application,
- when a booking including your name is confirmed,
- when a booking including your name is canceled or modified,
- when you make a payment to the club,
- when another user of the club sends you a message from the application,
- when the club sends you a message,
- when your account is suspended/reactivated by the club,
- when your subscription with the club expires.

7. Privacy & Confidentiality
Netatoo uses high ethical standards and respects the privacy of clubs and users. We diligently protect the confidentiality of your data and are committed to ensuring that no data is exchanged, transferred, or sold on any medium to third parties.

8. Disclaimer
The user expressly acknowledges using the application at their own risk and under their exclusive responsibility. Netatoo provides the user with information for indicative purposes, as is, with all its imperfections, errors, omissions, inaccuracies, and other ambiguities that may exist. In any case, Netatoo cannot be held liable:
- for any direct or indirect damage, particularly concerning loss of profits, loss of earnings, loss of clientele, or data that may result from the use of the application, or conversely from the inability to use it.
- for the content posted by the club on its homepage and pages.
- for the content posted by the user, particularly through booking and communication modules such as "Find a Partner" and "Messaging."
Netatoo's liability cannot be engaged due to a technical unavailability of the connection, whether due to a case of force majeure, maintenance, update, misconfiguration by the club, intervention by the host, internal or external strike, network failure, power outage, or even misconfiguration or use of the user's computer.

9. Governing Law – Jurisdiction
These terms and conditions are governed, interpreted, and applied under French law. Only the courts of Nancy (France) will have jurisdiction to hear any disputes relating to these terms of use and their implementation, including their validity, interpretation, execution, termination, and consequences.

10. Legal Notice
Netatoo SAS with a capital of 16,000€, represented by its president Simon Martins and registered with the Trade and Companies Register of Nancy, France under SIRET 48782045800031.
The registered office of Netatoo S.A.S. is located at 32 r nationale, 54300 Chanteheux, France.
